These Terms of Service ("Terms") govern your use of the services provided by Standard Limited Liability Company ("Company," "we," "us," or "our"), including our website, mobile application, and quote widget (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our Services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree, please do not use our Services.
2. Description of Services
We provide a software platform that enables home service businesses to generate and manage service quotes for residential customers. Our Services include an embeddable quote widget, property analysis tools, scheduling, and payment processing.
3. User Data and Photo Consent
By submitting a quote request, you consent to the collection and use of your personal information (including name, email, phone number, property address, and property photos) for the purpose of generating a service quote and facilitating a service relationship between you and the home service business.
Property photos you upload are used solely to assist in generating an accurate service quote. They may be analyzed using automated tools. By uploading photos, you represent that you have the right to share images of the property in question.
4. Quotes and Pricing
All quotes generated through our Services are estimates based on the information you provide. Final pricing may vary based on on-site assessment. Quotes are not guaranteed contracts and are subject to change upon the service provider's inspection of the property.
5. Payments
Payment processing is handled by Stripe. By submitting a payment, you agree to Stripe's terms of service. We do not store your full payment card details. All payments are subject to our refund policy as communicated at the time of booking.
6. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or any service provided by a business through our platform. The Company is a software provider and is not responsible for the quality, safety, or performance of services delivered by independent home service businesses using our platform.
7. Third-Party Services
Our Services may use third-party APIs and data sources (such as mapping and property data services) to provide accurate quotes. We are not responsible for the accuracy of data provided by third parties. Your use of information derived from third-party sources is at your own risk.
8. Intellectual Property
All content, features, and functionality of our Services are owned by the Company and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of our Services without our prior written consent.
9. Termination
We reserve the right to suspend or terminate your access to the Services at any time, for any reason, without prior notice, including for violations of these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in St. Louis County, Minnesota.
11. Changes to Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our Services. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
